national term:

dispensere

national definition:

english term:

grant exemption

english definition:

Exemptions may be granted from several features in Danish planning. A municipal council may grant limited exemptions from the municipal plan but not to the extent that a local plan would be required. If a local plan is required, a supplement to the municipal plan must be prepared and adopted. Further, a municipal council may grant exemptions from the provisions of a local plan as long as the exemptions do not contradict the principles of the plan. The provisions about use and purpose of a local plan typically express the principles of the plan and therefore comprise key guidelines for delimiting the municipal council’s ability to deviate from a plan by granting exemptions. All exemptions must be assessed individually. General exemptions from a plan cannot be granted, as this would mean altering the plan without complying with the procedures for producing plans. Finally, exemptions from protection and building lines may be granted, which may be required to implement the content of a local plan.

However, in some cases granting an exemption requires the consent of an authority at a higher level.

The affected parties – landowners, neighbours and users – must normally be informed before an exemption may be granted.
