Bestemmelsen i planlovens § 44 fastslår, at bestemmelserne i §§ 42 og 43 ikke gælder for offentligretlige servitutter, dvs. servitutter pålagt med hjemmel i lov.
Det karakteristiske for offentligretlige servitutter er

  • At de er udstedt af en offentlig myndighed
  • At pålægget af servitut kan ske uden ejerens samtykke
  • At servitutdokumentet ikke skal angive den påtaleberettigede.
Eksempler på offentligretlige servitutter er
  • Betingelser for dispensationer og tilladelser efter planlovens § 19 henholdsvis § 35 som tinglyses på ejendommen,
  • Fredningsbestemmelser efter naturbeskyttelsesloven,
  • Vejbyggelinier efter vejlovgivningen.
I planlægningssammenhæng kan en servitut bruges til at regulere forhold, som en lokalplan ikke kan indeholde bestemmelser om. I praksis bruges servitutter bl.a. til regulering af byøkologiske tiltag, fx sprøjteforbud og krav om energispare-installationer.

The provisions in §44 of the Planning Act stipulate that the provisions in §42 and §43 do not apply to easements imposed by public authorities in accordance with legislation. Public easements:

  • are issued by a public authority;
  • may be placed without the property owner’s consent; and
  • mean that the easement document has no obligation to mention which parties have the right to bring legal proceedings.
Examples of public easements are:
  • conditions for exemptions and permits granted in accordance with §19 and §35 of the Planning Act which are registered for the property in the land registry;
  • nature conservation provisions in accordance with the Protection of Nature Act; and
  • road-building lines in accordance with legislation on roads.
Regarding planning, an easement can be used to regulate matters that cannot be regulated in a local plan. In practice, for example, easements can be used to regulate initiatives in urban ecology, such as prohibiting the use of pesticides and requiring the use of energy-saving installations.
