Ehitusseadus defineerib ehitusloa kui kohaliku omavalitsuse nõusoleku: 1) püstitada ehitusloale märgitud maaüksusele ehitis ja ehitise teenindamiseks vajalikke rajatisi;
2) laiendada ehitusloale märgitud ehitist või selle osa; 3) rekonstrueerida ehitusloale märgitud ehitist või selle osa; 4) lammutada ehitusloale märgitud ehitist või selle osa. Ehitusluba annab ühtlasi õiguse ehitise tehnosüsteemide muutmiseks. Ehitamiseks peab olema ehitusluba, välja arvatud väikeehitise ehitamise korral. Ehitusluba ei anna õigust ehitusloale märgitud maaüksuse või ehitise omaniku loata ehitada. Ehitusloa väljastab ja tunnistab kehtetuks kohalik omavalitsus.
Ehitusloa saamiseks tuleb: esitada ehitusloa taotlus; esitada ehitusprojekt, mis vastab ehitusloa taotlemisel ehitusprojektile esitatavatele nõuetele ja on koostatud või kontrollitud projekteerimises pädeva või kontrollitud ehitusprojektide ekspertiiside tegemises pädeva vastutava spetsialisti poolt ja mis on seadustega ettenähtud juhtudel heaks kiidetud; tasuda riigilõiv. Planeerimisseadus ütleb, et ehitisele, millele on antud ehitusluba enne ehituskeelu kehtestamist, ei laiene ajutine ehituskeeld.

Building Act defines a building permit as a consent granted by a local government for: the erection of a construction works, and of civil engineering works necessary to service the construction works, on the land unit specified in the building permit; the expansion of the construction works or a part thereof specified in the building permit; the reconstruction of the construction works or a part thereof specified in the building permit; the demolition of the construction works or a part thereof specified in the building permit. A building permit also grants the right to modify the utility systems of the construction works.
A building permit is mandatory for building, except in the event of the building of small construction works. A building permit does not grant the holder thereof the right to build without the permission of the owner of the land unit or construction works specified in the building permit.
Building permits are issued and revoked by local governments.
In order to obtain a building permit, a person shall: submit an application for a building permit; submit building design documentation which conforms to the requirements established for the building design documentation to be submitted upon application for a building permit, which has been prepared or verified by a specialist in charge who is competent in design or which has been verified by a specialist in charge who is competent in the expert assessment of building design documentation, and which has been approved in cases prescribed by law; pay the state fee.
Planning Act says that a temporary building ban does not apply to buildings for which building permits that have been issued prior to the establishment of the building ban.
