national definition:Huvitatud isik on iga inimene, grupp või organisatsioon, kes on huvitatud planeeringu koostamisest ja kehtestamisest. Planeerimisseadus lubab kohalikul omavalitsusel sõlmida detailplaneeringu koostamisest huvitatud isikuga lepingu detailplaneeringu koostamise kohta. Lepinguga määratakse kohaliku omavalitsuse ja detailplaneeringu koostamisest huvitatud isiku kohustused detailplaneeringu koostamisel ja planeeringu koostamise rahastamisel. Seadus lubab, et huvitatud isik tagab detailplaneeringu koostamiseks vajalikud vahendid, mille järel kohalik omavalitsus koostab planeeringu või tellib selle koostamise. Samuti võib huvitatud isik ise tellida detailplaneeringu koostamise. Seadus sätestab ka piirangu, mille järgi eraõiguslik isik ei tohi olla detailplaneeringu koostamise tellija looduskaitse ja muinsuskaitse alla võetud maa-aladel ega juhul, kui detailplaneeringu koostamine ei toimu vastavuses kehtestatud üldplaneeringuga või linnaosadega linnades vastavuses linnaosa kehtestatud üldplaneeringuga. Planeeringu avaliku väljapaneku ajal peab maavalitsuse või kohaliku omavalitsuse tööaja jooksul olema tagatud huvitatud isikute juurdepääs kõigile planeeringuga seotud materjalidele ja informatsioonile, mis on planeeringu koostamist korraldava maavalitsuse või kohaliku omavalitsuse käsutuses. english definition:Any person, group or organisation who is interested in the preparation and adotion of a plan. Planning Act provides that a local government may enter into a contract for the preparation of a detailed plan with a person interested in the preparation thereof. The contract shall determine the respective obligations of the local government and the person interested in the preparation of the detailed plan in the course of preparation of the plan and in the financing of its preparation. The Act allows that an interested person, based on contract, may provide the rural municipality/city with the necessary means for the preparation of plan; after that, the latter prepares the detailed plan or orders its preparation. It also allows that, based on a contract with rural municipality/city, an interested person may be the one who orders the preparation of plan. At the same time, the Act also enforces a restriction, according to which an interested person should not contract for the preparation of a detailed plan for the areas of significant public interest, i.e. the areas under nature conservation or heritage conservation, or the territories where public interests or general development needs have not been expressed in the adopted comprehensive plan or, in large cities, in the comprehensive plan adopted for the respective city district. During the time the plan is on public display, all interested persons shall have access to all material and information related to the plan in the possession of the county government or local government administering preparation of the plan during the office hours of the county government or local government. Public disclosure is mandatory in order to ensure the involvement of all interested persons and the timely provision of information to such persons and to enable such persons to defend their interests in the process of planning.
