national definition:Katastriüksus on katastris iseseisva üksusena registreeritud maatükk. Katastriüksuse registreerimisel peab katastripidaja katastris fikseerima katastriüksuse kõlvikute pindalad ja sihtotstarbe või sihtotstarbed. Planeerimisseaduses sätestatud detailplaneeringu koostamise kohustuse korral määrab kohalik omavalitsus katastriüksuse sihtotstarbe kehtestatud detailplaneeringu alusel. Ehitise või selle osa kasutamise otstarbe muutmisel, kui see ei too kaasa ehitamist, määrab kohalik omavalitsus katastriüksuse sihtotstarbe või sihtotstarbed ehitusseaduse kohases ehitise kasutusloas nimetatud ehitise või selle osa kasutamise otstarbe või otstarvete alusel. Kui ehitise või selle osa kasutamise otstarbe muutmisega kaasneb ehitamine, mis ei too kaasa detailplaneeringu koostamise kohustust, määrab kohalik omavalitsus katastriüksuse sihtotstarbe või sihtotstarbed ehitusseaduse kohases ehitusloas või kirjalikus nõusolekus nimetatud ehitise kasutamise otstarbe või otstarvete alusel. Planeerimisseaduse kohase detailplaneeringu koostamise kohustuse puudumise korral määrab kohalik omavalitsus katastriüksuse sihtotstarbe planeerimisseaduse kohase üldplaneeringu alusel. Üldplaneeringu puudumise korral määrab katastriüksuse sihtotstarbe kohaliku omavalitsuse volikogu.
cadastral unit
english definition:A plot of land registered in the cadastre as an independent unit. Upon registration of a cadastral unit, the cadastral registrar shall document the areas of the land use types and the intended use or uses thereof in the cadastre. As provided in the Land Cadastre Act, in the case where preparation of a detailed plan provided in the Planning Act is mandatory, the local government shall determine the intended use of the cadastral unit on the basis of an adopted detailed plan. The intended use of the cadastral unit is registered in cadastral register by the county cadastral office. Upon alteration of the purpose of the use of a construction works or a part thereof which does not result in building, the local government shall determine the intended purpose or purposes of the cadastral unit on the basis of the purpose or purposes of use of the construction works or a part thereof as specified in the permit for use of the construction works. If alteration of the purpose of the use of a construction works or a part thereof results in building which does not lead to the preparation of a detailed plan as being mandatory, the local government shall determine the intended purpose or purposes of the cadastral unit on the basis of the purpose or purposes of the use of the construction works specified in the permit for use or in the written permission for use of the construction works issued pursuant to the Building Act. The local government shall determine the intended purpose of a cadastral unit on the basis of the comprehensive plan prepared in compliance with the Planning Act unless preparation of a detailed plan is mandatory also in compliance with the Planning Act. In the absence of a comprehensive plan, the local government council shall determine the intended purposes of the cadastral unit.
