Maakasutustingimused määratakse seaduste ja teiste õigusaktidega, linna või valla ehitusmäärusega ning üld- ja detailplaneeringutega. Seadustest tulenevaid maakasutustingimusi saab kinnisvarale seada järgmiste planeeringute alusel: detailplaneeringuga linnades ja alevites ning teistel detailplaneeringu kohustusega aladel ja juhtudel; üldplaneeringuga detailplaneeringu kohustuseta aladel.

Land use provisions could be prescribed by legislative acts or other legal acts, building regulations of a city or rural municipality, and by a comprehensive plan. In some cases a comprehensive plan specifies the land use provisions prescribed by legal acts.  Land use provisions arising from law may be established for immovable property on the basis of the following plans: on the basis of an adopted detailed plan where preparation of a detailed plan is mandatory; on the basis of an adopted comprehensive plan where preparation of a detailed plan is not mandatory.
