Maa omanikul on õigus vallata, kasutada ja käsutada maad ning nõuda nende õiguste rikkumise preventsiooni teiste isikute poolt ja rikkumiste tagajärgede elimineerimist. Maaomand on registreeritud maaregistris. Planeeritava maa-ala kinnisasjade omanikud kaasatakse üldplaneeringu ja detailplaneeringu koostamisse. Detailplaneeringud koostatakse koostöös planeeritava maa-ala kinnisasjade omanikega ning olemasolevate või kavandatavate tehnovõrkude omanikega või valdajatega, et tagada planeeritava maa-ala varustatus tehnovõrkudega. Kui üldplaneeringu või detailplaneeringuga kavandatu toob kaasa kinnisasja sundvõõrandamise vajaduse või muudab omaniku tahte vastaselt senist maakasutust või krundi ehitusõigust, teatab kohalik omavalitsus tähtsaadetisena edastatud kirjaga vastava kinnisasja omanikule planeeringu avaliku väljapaneku ning üldplaneeringu avaliku arutelu toimumise aja ja koha hiljemalt kaks nädalat enne avaliku väljapaneku algust. Kohalik omavalitsus teatab tähtsaadetisena edastatud kirjaga üldplaneeringu või detailplaneeringu kehtestamisest ühe nädala jooksul planeeringu kehtestamise otsuse tegemise päevast arvates: kinnisasja omanikele, kelle senist maakasutust või ehitusõigust kehtestatud planeeringu alusel kitsendatakse; kinnisasja omanikele, kelle kinnistule kehtestati planeeringu koostamise käigus ajutine ehituskeeld.

An owner of land has the right to possess, use and dispose of  land, and to demand the prevention of violation of these rights and elimination of the consequences of violation from all other persons. The rights of an owner may only be restricted by law or the rights of other persons. Land ownership is registred in a land register. All immovables shall be entered in a land register unless otherwise provided by law. Owners of immovables located in the planning area shall be involved in the preparation of comprehensive and detailed plans.  A detailed plan shall be prepared in co-operation between the owners of the immovables located in the planning area and the owners or possessors of existing or planned utility networks in order to ensure that the planning area is supplied by utility networks.  If the proposals made in a comprehensive plan or detailed plan result in a need to expropriate immovables or in changes to the existing land use or building rights on the plots against the will of the owner, the local government shall, by way of registered letter and at least two weeks before displaying the plan to the public, inform the owners of the immovables concerned of the time and place of the public display of the plan and of the public discussion regarding the comprehensive plan. Within one week as of the decision to adopt a comprehensive plan or detailed plan, the local government shall, by way of registered letter, give notice of the adoption of the plan to: the owners of immovables whose current land use or building rights are restricted on the basis of the adopted plan; the owners of immovables concerning whose registered immovable a temporary building ban has been established in the course of preparing the plan.
