Swedenplaneeringu kooskõlastamine
national definition:Kooskõlastamine on planeeringu sisu ja õiguspärasuse eelkontroll asjaomaste võimuorganite poolt enne planeeringu vastuvõtmist ja kehtestamist. Üleriigiline planeering kooskõlastatakse ministeeriumide, maavanemate ja maakondlike kohalike omavalitsuste liitudega. Enne planeeringu vastuvõtmist kooskõlastab planeeringu koostamist korraldav maavanem või kohalik omavalitsus: 1) maakonnaplaneeringu – planeeritava maa-ala naabrusesse jäävate maakondade maavanematega ja planeeritava maa-ala kohalike omavalitsustega; 2) üldplaneeringu – planeeritava maa-ala naabrusesse jäävate kohalike omavalitsustega ja maakonna keskkonnateenistusega; 3) üldplaneeringu ja detailplaneeringu – vastava riigiasutusega või kaitseala valitsejaga, kui planeeritaval maa-alal asub riikliku kaitse alla võetud maa-ala või üksikobjekt või planeeringuga tehakse ettepanek selle kaitse alla võtmiseks või kui planeeritaval maa-alal asub riigi omandisse kuuluv maavara või altkaevandatud ala. Seadus ütleb, et kui kooskõlastamisel ei viidata vastuolule seaduse või seaduse alusel kehtestatud õigusakti või kehtestatud planeeringuga, loetakse planeering kooskõlastatuks, vaatamata planeeringu kohta esitatud teistele ettepanekutele ja vastuväidetele. Kooskõlastus antakse kirjalikus vormis. Kooskõlastuse kokkuvõte vormistatakse tabelina.
concertation of a plan
english definition:Concertation is the pre-control of the content and the legality of the plan by relevant authorities prior to finalising the preparation of the plan and adopting it. Concertation for a national spatial plan shall be sought from ministries, county governors and county local government associations. Prior to adoption of a plan a county governor or local government administering preparation of the plan shall seek concertation for: a county plan from the county governors of counties neighbouring on the planning area and from the local governments of the planning area; a comprehensive plan from the local governments neighbouring on the planning area and from the county environmental services; a comprehensive plan or a detailed plan from the relevant state authority or manager of a protected area if the planning area includes an area or object placed under state protection or if the plan serves as a proposal to place that object under protection or if earth deposits belonging to the state or subsurface mining areas are located in the planning area.
The additional need to seek concertation for plans from state authorities or county environmental services shall be determined by: the Ministry of Internal Affairs for a county plan; the county governor for a comprehensive plan, a detailed plan including a proposal to amend a comprehensive plan, or a detailed plan prepared for an area where there is no comprehensive plan; the local government for a detailed plan prepared on the basis of an adopted comprehensive plan.
Planning Act says that a plan is deemed to have been concerted regardless of any proposals or objections submitted concerning the plan unless, upon seeking concertation, reference is made to contradiction with an Act, legislation established on the basis of an Act or an adopted plan.
Concertation is given in written format. The summary of concertation should be formulated as a table, where also the opinion of local government on concertation is included.
