Määräaikainen rakentamisrajoitus

Kaavassa määrätty rakentamista koskeva määräaikainen ja ehdoton rajoitus, jolla estetään rakennustoimintaan tarkoitetun alueen käyttö muuhun kuin maatalouden tai siihen verrattavien elinkeinojen tarpeisiin.

Määräaikainen rakentamisrajoitus voi olla voimassa yleiskaava-alueella. Sen enimmäismääräaika on viisi vuotta. Määräaikainen rakentamisrajoitus edellyttää erityistä määräystä kaavassa, jossa on myös esitettävä riittävän tarkoin alue, jolla määräys on voimassa. Määräaikaisesta rakentamisrajoituksesta voi anoa poikkeusta (poikkeamispäätös).

Temporary building restriction (fixed-term building restriction)

english definition:

A temporary and strict restriction set in the plan, concerning building. It is used to prohibit the use of land designated for building for any construction other than serving the needs of agriculture or corresponding means of livelyhood.

A temporary building restriction may be valid in areas of a local master plan. The maximum period is five years. A temporary building restriction requires a special order in the plan, in which also the area the restriction concerns have to defined exactly enough. It is possible to apply for a deviation from a temporary building restriction (a deviation decision).
