Perusrakennussoikeus (hajarakentamisoikeus)

national definition:

Maanomistajan oikeus rakentamiskelpoisen maan tavanomaiseen, kohtuulliseen ja järkevään käyttämiseen rakentamistarkoituksessa; yleensä täsmällisemmin tarkoitetaan maanomistajan oikeutta rakentaa haja-asutusmaisesti pientaloja taajamien ulkopuolella tietyin edellytyksin.

Käsite ei esiinny laissa, mutta on laajalti käytössä suunnittelun käytäntökielessä.

Perusrakennusoikeus on suomalainen erityispiirre, maan tapa ja oikeusnormi, jota ei juurikaan ole muualla Euroopassa.

Basic building right

english definition:

A right of the landowner to a customary and reasonable use of a land suitable for building for building purposes. Usually the term is used to refer more exactly to the right of the landowner to build detached houses outside the densely populated areas in a way of a dispersed settlement, on certain conditions.

The tem does not exist explicitly in the Land Use and Building Act, but it is much used in practice.

Basic building right is a Finnish special characteristic, a national custom and a legal norm that does not much exist elsewhere in Europe.
