Ja kāda zemesgabala izmantojums likumīgi iesākts, pirms pieņemti ir apbūves noteikumi vai detālplānojums, kas nosaka tam citu izmantošanas veidu, tad šim zemesgabalam ir neatbilstoša izmantojuma statuss. Neatbilstoša izmantojuma statusa zemesgabala īpašnieks ir tiesīgs turpināt likumīgi iesākto izmantojumu, bet jebkuru jaunu apbūvi, piebūvi, esošo ēku pārbūvi, restaurāciju un nojaukšanu jāveic atbilstoši šo apbūves noteikumu un detālplānojuma prasībām.

improper utilization status

If the utilization of any land plot has legally commenced prior these binding regulations or detail plan has been adopted, which has prescribed another type of utilization thereof then the land plot has status of improper utilization. The owner of land plot with the status of improper utilization has rights to continue the legally commenced utilization, but any new building, extension of buildings, rebuilding of existing buildings, demolish as well has to be carried out in accordance with the requirements of these binding regulations and detail plan.
