Īpašuma piespiedu atsavināšana sabiedrības vajadzībām pieļaujama tikai izņēmuma gadījumos uz atsevišķa likuma pamata pret taisnīgu atlīdzību. Vietējām pašvaldībām ir pirmpirkuma tiesības, ja pašvaldību administratīvajā teritorijā tiek atsavināts nekustamais īpašums un tas nepieciešams, lai pildītu likumā noteiktās pašvaldību funkcijas. Valstij ir pirmpirkuma tiesības uz zemi aizsargājamās teritorijās, izņemot zemi neitrālajās zonās.

english definition:

Expropriation of property for public purposes shall be allowed only in exceptional cases on the basis of a specific law and in return for fair compensation. Territorial local governments have the right of first refusal, if immovable property in the local government administrative territory is being alienated and such is necessary to perform the local government functions prescribed by law. The State has the right of first refusal to the land in protected territories, except the land in neutral zones.
