national definition:Zemesgabals ir zemes virsmas platība, kas norobežota ar dabiskajiem situācijas elementiem - ceļiem, hidrogrāfijas, reljefa kontūrām u.c.) vai apvidū noteiktām robežām, un tam var nebūt piešķirts kadastra numurs. (Zemes ierīcības likums) Būvniecības likuma izpratnē zemes gabals (pamatgabals) ir zemes vienība vienā administratīvi teritoriālā vienībā ar tam noteiktām robežām apvidū un kartogrāfiskā materiālā vai zemes reformas laikā - tikai kartogrāfiskā materiālā, kurš reģistrēts Nekustamā īpašuma valsts kadastra reģistrā. Zemes gabalu var apbūvēt tā īpašnieks vai cita persona, kas noslēgusi līgumu ar attiecīgā zemes gabala īpašnieku. Zemes gabalu drīkst apbūvēt, ja tā apbūve nav pretrunā ar teritorijas plānojumu un detālo plānojumu. Pašvaldība var neatļaut apbūvi vai ierosināt to koriģēt, savā lēmumā motivējot, kādas likumu normas nepieļauj šādu būvniecību, kā arī ņemot vērā teritorijas plānojuma (detālā plānojuma) un būvniecības publiskās apspriešanas rezultātus. Zemesgrāmatā ieraksta nekustamam īpašumam pievienotos zemes gabalus (agrāk - gruntsgabalus) un to platību. (Zemesgrāmatu likums)
land plot
english definition:A land plot is an area of land, which has been delimited with natural elements of the situation (with the roads, hydrographic, outlines of terrain etc.) or with borders, which have been determined in the area, but the cadastre number may be not be issued thereof.
In accordance to construction legislation, land plot is a plot of land in single administrative-territorial unit with boundaries set in the area and in cartographic material or, during the land reform - only in the cartographic material, which is registered in the State Cadastre of Immovable Property. A land plot may be built on by the owner thereof or another person who has entered into a contract with the owner of the relevant land parcel. A parcel of land may be built on if the building thereof is not in conflict with the territorial spatial plan and detailed plan. A local government may prohibit building or suggest adjustments thereof, substantiating the decision thereof with the legal provisions that do not allow such construction, as well as taking into account the results of the public discussion of the territorial spatial plan (detailed plan) and construction.
Land plots and their area that are a part of a real estate are registered in the Land Register (Land Book).
