Bebyggelsesplan

Lovfestet fysisk plan for fastlegging av arealbruk, utforming av bygninger, anlegg og tilhørende utearealer innenfor et nærmere avgrenset område hvor det etter kommuneplanens arealdel eller reguleringsplan, se denne, er stilt krav om slik plan for utbygging.

I bebyggelsesplan kan det innenfor rammen av arealdelen i kommuneplanen eller reguleringsplan i medhold av reguleringsformålene, foretas de suppleringer og endringer i slike planer som finnes nødvendig for å gjennomføre utbyggingen.

Initiativ til utarbeidelse av bebyggelsesplan kan tas av det faste utvalg for plansaker eller av den som måtte ønske å fremme forslag om slik plan. Kravene til medvirkning, samarbeid mot andre berørte myndigheter og offentliggjøring er som for reguleringsplan, se denne. Medfører forslaget til bebyggelsesplan annet enn mindre vesentlige endringer, se dette, til arealdelen i kommuneplan eller reguleringsplan, skal den legges frem for nabokommuner, fylkeskommunen og statlige sektormyndigheter på tilsvarende måte som for reguleringsforslag, se reguleringsplan.
Bebyggelsesplan vedtas med endelig virkning av det faste utvalg for plansaker hvis det ikke er reist innsigelser mot planen og ingen påklager utvalgets avgjørelse til departementet. Skulle nabokommuner, fylkeskommunen eller statlige sektormyndigheter ha reist innsigelser mot planforslaget, må det sendes kommunestyret og behandles som reguleringsforslag, se reguleringsplan.

En endelig vedtatt bebyggelsesplan har samme virkninger som en endelig vedtatt reguleringsplan.

Building development plan

 Statutory physical plan for designating land use, designing of buildings, installations and associated outside areas within a specifically delimited area where, according to the Land use part of the municipal master plan or a Zoning plan, such plan is required for development.

A Building development plan may, within the framework of the Land use part of the municipal master plan or a Zoning plan concerning the land use categories (cf.), provide for any supplements or changes to such plans as are considered necessary to carry out the development.

The municipal Standing Committee for Planning Matters or anybody else can initiate preparation of building development plan proposals for public handling. Requirements for public participation, collaboration towards other authorities concerned and publication are similar as for the Zoning plan (cf.). If the plan proposal causes other than minor changes to the Land use part of the municipal master plan or to a Zoning plan, it shall be submitted to neighboring  municipalities, the County municipality and State sectoral authorities as for a Zoning plan proposal.
 
As far no objection is raised against the plan proposal the decision of the Standing Committee for Planning Matters to adopt the plan is final provided that nobody appeals this decision for ministerial conclusion. If any objection to the plan is received from neighboring municipalities, the County Municipality or State sectoral authorities, whose area of responsibility will be affected, the plan has to be sent to the Municipal Council and be dealt with in the same way as a Zoning plan (cf.).

The effects of a finally adopted building development plan are the same as for a Zoning plan (cf.).
