Fylkesplanlegging

Lovfestet obligatorisk planlegging som skal samordne statens, fylkeskommunens og i hovedtrekkene kommunenes fysiske, økonomiske, sosial og kulturelle virkesomhet i fylket.

Fylkesplanleggingen skal bygge på de økonomiske og andre ressursmessige forutsetninger for gjennomføring. Fylkeskommunen er pliktig å sørge for at det innen fylkets område utføres løpende fylkesplanlegging.

Departementet fører tilsyn med at denne plikten overholdes. Departementet kan gi bestemmelser om samarbeid mellom to eller flere fylkeskommuner om fylkesplanleggingen. Oslo kommune likestilles i denne forbindelse med en fylkeskommune. Videre kan departementet gi bestemmelser om opprettelse av nødvendige samarbeidsorganer, om hvilke oppgaver samarbeidet skal gjelde og om hvilket geografisk område det skal omfatte. Før slike bestemmelser blir gitt, skal vedkommende fylkeskommuner ha hatt høve til å uttale seg.

Øverste planleggingsmyndighet i fylkeskommunen er fylkestinget som har ansvaret for og ledelsen av arbeidet med fylkesplanleggingen. Fylkesrådmannen har det administrative ansvaret for fylkeskommunens oppgaver. I denne sammenheng skal hver fylkeskommune ha en fagkyndig planleggings- og utbyggingsadministrasjon for utarbeiding og behandling av planer og planfaglig veiledningsvirksomhet etter loven. Andre organer som har oppgaver vedrørende ressursutnytting, vernetiltak, utbygging og kulturell eller sosial utvikling innenfor fylkets område, skal gi fylkeskommunen nødvendig hjelp i planleggingsarbeidet.

Fylkesmannen skal føre tilsyn med at statlige organer oppfyller sin plikt til å yte bistand. Slike organer skal etter anmodning fra fylkeskommunen delta i rådgivende utvalg som fylkeskommunen oppretter til å fremme samarbeid om planleggingsvirksomheten.

County planning

Statutory and obligatory planning that coordinates State, County and the main aspects of municipal physical, economic, social and cultural activities within the County.

This planning shall be based on financial and other resource-related prerequisites for its implementation. The County Municipality shall ensure that county planning is carried out continuously with its territory.

The Ministry shall oversee compliance with this obligation. The Ministry may lay down provisions concerning cooperation between two or more counties in connection to county planning. The municipality of Oslo is regarded as a county in this regard. Hereunder, the Ministry may lay down provisions concerning the establishment of the necessary cooperative bodies, concerning which tasks cooperation shall encompasses and concerning which geographical areas is shall cover. Before such provisions are laid down, the counties concerned shall have been given an opportunity to express their views.
The County Council is responsible for and shall administer the tasks on county planning. The Chief County Administrator is responsible for administering the tasks of the county pursuant to the Planning and Building Act. Every county shall have an expert planning and development administration to prepare and consider plans and to provide expert advice on planning pursuant to the Act. Public agencies whose tasks concern use of resources, protection and conservation, physical development and cultural or social development within the area covered by the county shall give the County Municipality necessary assistance in planning work.

The County Governor shall oversee that state bodies fulfill their obligations to provide necessary assistance. Such bodies shall, at request take part in advisory committees established by the County Municipality to promote cooperation in planning.
