Jordvern

Generell betegnelse på lovfestet vern av dyrket og dyrkbar jord.
Jordloven inneholder bestemmelser om jordvern. Dyrket jord må ikke brukes til formål som ikke tar sikte på jordbruksproduksjon. Dyrkbar jord må ikke anvendes slik at den i fremtiden blir uegnet til jordbruksproduksjon. Eiendom som blir eller kan bli brukt til jord- eller skogbruk kan videre ikke deles uten samtykke fra departementet. Landbruksdepartementet kan gi dispensasjon fra forbud mot omdisponering og deling. Jordvernet i henhold til denne loven gjelder ikke for arealer som i bindende arealdel til kommuneplanen er lagt ut til byggeområder, områder for råstoffutvinning, eller landbruks- natur- og friområder hvor det er krav om utbyggingsplan for deling og bygging kan finne sted. Tilsvarende gjelder for arealer omfattet av reguleringsplan og bebyggelsesplan med unntak av reguleringsformålene landbruk og fareområde.

Protection of cultivated and cultivatable land

General term for statutory conservation of cultivated and cultivatable land.The Land Act regulates protection of cultivated and cultivatable land. Cultivated land should not be used for purposes beyond the possibilities for agricultural production. Cultivatable land should not be used in a way that in the future will be an obstacle for agricultural production. Without ministerial consent property that is or might be used for agriculture and forestry should not be subdivided. Ministry of Agriculture can exempt from bans against the transfer of land use and subdivision of property.This protection of existing and potential agriculture land does not apply for areas, which in a legally binding Land use part of the municipal master plan are designated for Building areas, Extraction areas or Areas for agriculture, nature and recreation (cf.) where development plans are required for scattered development. The same is the case for areas zoned according to a Zoning plan or a Building development plan, except for the land use categories Agriculture areas and Danger areas.
