Kommunal planlegging

Generell betegnelse på kommunenes samordnende planlegging. Kommunene skal utføre en løpende kommuneplanlegging med sikte på å samordne den fysiske, økonomiske, sosiale, estetiske og kulturelle utvikling innenfor sine områder. Kommuneplanleggingen skal bygge på de økonomiske og de øvrige ressursmessige forutsetninger for gjennomføring. Departementet skal føre tilsyn med at plikten til løpende kommuneplanlegging blir overholdt.

Kommunestyret har ansvaret for og ledelsen av kommuneplanleggingen. I hver kommune skal det være et fast utvalg for plansaker. Ved parlamentariske styreform kan funksjonene til dette utvalget legges til kommunerådet. Kommunestyret skal utpeke/ansette etatssjef eller annen tjenestemann som skal ha særlig ansvar for å ivareta barns interesser når det faste utvalget utarbeider og behandler forslag til planer.

Lederen av kommunens administrasjon har det administrative ansvar for kommunens planleggingsoppgaver etter plan- og bygningsloven.

Offentlige organer som har oppgaver vedrørende ressursutnytting, vernetiltak, utbygging eller sosial og kulturell utvikling innenfor kommunens område, skal gi kommunen nødvendig hjelp i planleggingsarbeidet. Slike organer skal etter anmodning fra kommunen delta i rådgivende utvalg som kommunestyret oppretter til å fremme samarbeid om planlegging. Etter at kommunen og vedkommende fylkeskommunale eller statlige organ har uttalt seg, kan departementet frita disse fra å delta i slike samarbeidsutvalg.

Tilnærmet all offentlig planlegging på lokalt nivå foregår i kommunal regi. Den omfatter aktivitetsplanlegging innenfor kommunale sektorer koordinert i forhold til annen offentlig planlegging, samt myndighet til iverksetting av planlegging, utarbeidelse og godkjenning av planer for kommunens fysiske utvikling. Den er også myndighet for byggesaker.

Kommunenes ansvar og oppgaver i denne sammenheng er forholdsvis detaljert regulert ved lov. Kommunenes størrelse og situasjonen lokalt medfører imidlertid at kommuneplanleggingens innhold, utførelse og gjennomføring kan variere betydelig kommunene i mellom.

Municipal planning

General term for the comprehensive planning activities of the Municipality. Municipalities shall carry out continuous planning with a view to coordinating physical, economic, social, aesthetic and cultural development within their own areas. Municipal planning shall be based on the financial and other resource related prerequisites for implementation. The Ministry shall oversee compliance with the obligation to carry out continuous municipal planning.

The Municipal Council is responsible for and shall administer municipal planning. In each municipality there shall be a Standing Committee for Planning Matters. In municipalities with a parliamentary system of government, the Municipal Council may assign the Committee’s function to the Municipal Executive board. The Municipal Council shall designate a head of department or another civil servant who shall have particular responsibility for safeguarding the interests of children when the Standing Committee prepares and considers proposals for plans.

The head of the municipal administration shall be administratively responsible for the Municipality’s planning pursuant to the Planning and Building Act.

Public bodies with tasks concerning use of resources, protection and conservation, physical development, or social and cultural development within the area covered by the Municipality shall give necessary assistance in planning activities. Such bodies shall, at request of the Municipality, participate in advisory committees established by the Municipal Council in order to promote cooperation in planning.  After the Municipality and the county municipal and state bodies concerned have expressed an opinion, the Ministry may exempt them from participating in such committees.

By and large most public planning at local level takes place under municipal government. It comprises activity planning within municipal sectors coordinated towards other kinds of public planning, and in addition the authority to initiate, carry out and approve plans for the physical environment within the municipal area. The Municipality is also building authority and responsible for building permitting.

The responsibility and duties of the Municipality are rather exhaustive regulated through rules and regulations. However, the content of municipal planning, the performing and implementing of it will be varying due to differences of scale and local conditions.
