Kommuneplan

Eneste lovgitte og obligatoriske plantype for samordnende kommuneplanlegging, se kommunal planlegging.I en hver kommune skal det utarbeides en kommuneplan. Denne planen skal inneholde en langsiktig og en kortsiktig de, se dette.

Kommunestyret iverksetter utarbeidelse av kommuneplan og godkjenner planen med endelig virkning hvis det ikke er reist innsigelser eller departementet innkaller planen for eventuelle endringer. Minst en gang i løpet av hver valgperiode (4 år) skal kommunestyret vurdere kommuneplanen samlet, herunder om det er nødvendig å endre den.I god tid før utkast til kommuneplan behandles i kommunestyret skal kommunen sørge for å gjøre de mest aktuelle spørsmål i planarbeidet kjent på en måte den finner hensiktsmessig, slik at den blir gjenstand for offentlig debatt. Utkast til kommuneplan sendes fylkeskommunen, berørte statlige organer og organisasjoner som har særlig interesse i planarbeidet og legges ut til offentlig ettersyn iht. kunngjøring etter at den har vært forelagt det faste utvalg for plansaker, Disse kravene til offentliggjøring og offentlig ettersyn gjelder ikke ved rullering av kommunens samlede handlingsprogram. Frist for merknader til planen bør ikke settes kortere enn 30 dager. Saken legges deretter frem for kommunestyret til avgjørelse. Hvis det ikke er reist innsigelser mot planen eller departementet ønsker å foreta endringer i planen, er kommunestyrets godkjennelse endelig, se innsigelse. Når planen er vedtatt skal den kunngjøres og ett eksemplar sendes departement, fylkesmann, fylkeskommune og berørte statlige fagmyndigheter.

Municipal master plan; local comprehensive plan

The only statutory and obligatory comprehensive local plan, cf. Municipal planning.A municipal master plan shall be prepared in each municipality. This plan shall comprise a Long-term and a Short-term component (cf.).

The Municipal Council initiates preparation of the municipal master plan and is mandated for final approval of the plan, provided that no objection is risen against it or the Ministry has required review for eventual changes. At least once during every election period (4 years) the Municipal Council shall evaluate the municipal master plan as a whole, including whether it is necessary to change it in any way.
In good time before the municipal master plan is considered by the Municipal Council the planning authority shall make sure that the most relevant matters in the municipal planning work are made known in a manner that it finds appropriate, to enable them to become a topic for public debate. A draft plan shall be sent to the County Municipality, affected state bodies, and organizations etc. that have particular interests in the planning work, and shall be made available for public inspection after review of the Standing Committee for Planning Matters. These requirements for publication and public inspection do not apply to the updating of the Municipality’s overall action program. A time limit, not less than 30 days, may be stipulated for expressing an opinion to the plan. The case shall then be submitted to the Municipal Council for decision. Without objections and ministerial requirements for review and eventual changes, is the approval of the Municipal Council final, cf. objection. When the plan is final, it shall be made public in an appropriate manner in the municipality, and one copy should be distributed to the Ministry, the County Governor, the County Municipality and state sectoral authorities concerned.
