Medvirkning

Lovfestet betegnelse på bestemte former for samhandling mellom planmyndigheter og planleggende enhet på den ene side og gruppering som berøres av eller har spesiell interesse i planleggingen på den andre.

 

Utover krav til offentlig opplysningsplikt, informasjon samt samråd og berørtes rett til uttalelse før vedtak fattes, er det ingen lovfestede krav til medvirkningsformer på bestemte trinn i planprosessen, ei heller at bestemte former for medvirkning er en entydig betingelse for at planer kan tillegges rettsvirkninger. Planlyndighetene i stat, fylkeskommune og kommune skal fra et tidlig tidspunkt i planleggingsarbeidet drive en aktiv opplysningsvirksomhet overfor offentligheten om planleggingsvirksomheten etter plan- og bygningsloven. Berørte enkeltpersoner og grupper skal gis anledning til å delta aktivt i planprosessen. Ved kunngjøring av planutkast for alle lovfestede plantyper skal det gjøres oppmerksom på om det foreligger alternative lovfestede utkast til planen som ikke har eller vil bli kunngjort. Det skal i tilfelle opplyses at de er tilgjengelige hos planmyndigheten. En hver har rett til å gjøre seg kjent med utkast til lovfestede planer og med de dokumenter som ligger til grunn for planutkastene, med de unntak som følger av offentlighetsloven.

Official and statutory term characterizing communicative connections between planning authorities and the plan preparation entity on the one hand, and groups of particular interests and directly affected people on the other.

 

Except requirements for publication, information and consultation and concerned interests rights to express an opinion before decision is taken, there are no statutory requirement for certain forms of participation at different stages of the planning process, or that the use of specific participatory instruments should be considered a clear condition for validating the plan.

The state, county municipal and the municipal planning authorities shall make an active effort at an early stage of the planning work to inform the public about planning activities pursuant to the Planning and Building Act. Affected individuals and groups shall be given an opportunity to participate actively in the planning process. When statutory categories of plans are published, it shall be pointed out whether there are alternative statutory draft plans, which have not been or will be made public. If so, it shall also be pointed out that these are available at the office of the planning authority. Any person has the right, at the office of the authority concerned, to acquaint himself with the alternative statutory draft plans and with the documents forming the basis for these plans, with the exceptions that follows from the Public Administration Act.
