Warunki zabudowy i zagospodarowania terenu

Decyzja administracyjna wójta, burmistrza lub prezydenta miasta wydana na wniosek osoby lub instytucji zamierzającej dokonać trwałych zmian w przeznaczeniu, zagospodarowaniu lub zabudowie terenu. Warunki poprzedzają pozwolenie na budowę. W przypadku braku planu miejscowego warunki wydaje się w trybie rozprawy administracyjnej, a ich treść przygotowuje osoba posiadająca uprawnienia urbanistyczne. Decyzja o warunkach wydawana jest po wymaganych prawem uzgodnieniach. Decyzja określa rodzaj inwestycji, warunki wynikające z miejscowego planu zagospodarowania przestrzennego, warunki wynikające z przepisów szczególnych, warunki obsługi w zakresie infrastruktury technicznej, wymagania dotyczące ochrony osób trzecich, linie rozgraniczające teren inwestycji wyznaczone na mapie oraz okres ważności decyzji.

Dla tego samego terenu decyzję o warunkach można wydać więcej niż jednemu wnioskodawcy. Ustawa określa przypadki, w jakich można odmówić ustalenia warunków zabudowy i zagospodarowania terenu.

Conditions of Development and Spatial Management

english definition:

An administrative decision made by the head of a rural commune, a town mayor or a city mayor issued on request from a person or an institution planning to introduce permanent changes in the original function, buildings or land use of an area. A building license is preceded by the conditions. In case of a lack of a local plan the conditions are issued in the mode of an administrative hearing, while the content is prepared by a person with professional town planning powers. The decision about conditions is issued prior to arrangements required by law (legal requirements).The decision defines a type of a development, conditions resulting from a local spatial management plan, conditions resulting from special provisions, maintenance/service conditions within technical infrastructure, requirements concerning protection of third parties, investment dividing lines determined on the map and validity of the decision.

Decision about the conditions of a given area can be issued to more than one applicant. The act of law defines cases when issuing of development and management conditions can be refused.
