Zarzut

Pisemnie wyrażone zastrzeżenie do ustaleń projektu miejscowego planu zagospodarowania przestrzennego. Zarzut może wnieść każdy, czyj interes prawny lub uprawnienia zostały naruszone przez ustalenia projektu tego planu. Zarzut formułuje się w stosunku do projektu planu wyłożonego do publicznego wglądu. O uwzględnieniu lub odrzuceniu zarzutu rozstrzyga rada gminy, w drodze uchwały, zawierajęcej uzasadnienie faktyczne i prawne. Uchwalę o odrzuceniu zarzutu w całości lub części, wnoszący zarzut może zaskarżyć do sądu administracyjnego, w terminie 30 dni od dnia jej doręczenia.

Charge

Written objection towards the arrangements of the project of a local spatial management plan. Charge can be raised by anybody whose legal interest or rights have been violated by the project arrangements of that plan. Objection is formulated towards the plan project made available to the public inspection. The acceptance or rejection of a charge is decided by the commune board by way of a resolution including the factual and legal statement of reasons. The claimer can appeal against the resolution on a partial or total rejection of a charge to an administrative court within 30 days since the delivery of a decision.
