Zmiana planu

Dostosowanie ustaleń miejscowego planu zagospodarowania przestrzennego do nowych warunków i postulatów. Zmiana planu przeprowadzona jest przy zachowaniu tej samej procedury, jaka obowiązuje przy sporządzaniu nowego planu. Zmiana może dotyczyć całego obszaru objętego planem lub jego części, może dotyczyć tylko tekstu planu lub tekstu i rysunku planu. Podstawą decyzji o potrzebie dokonania zmiany planu jest uchwała rady gminy, podjęta po analizie zgłoszonych wniosków oraz ocenie stanu zagospodarowania i po stwierdzeniu dezaktualizacji obowiązującego planu. Zmiana planu powoduje wygaśnięcie uprzednio wydanych decyzji o warunkach zabudowy i zagospodarowania terenu, które są sprzeczne z ustaleniami zmienionego planu, jeśli na ich podstawie nie udzielono pozwolenia na budowę.

Change of a Plan

Adjustment of provisions of a local spatial management plan to new conditions and postulates. Change of a plan is carried out in observance of due procedure, which is binding while making a new plan. The change may concern the whole area covered by the plan or its part, it may refer to the text plan or both the text and the plan blueprint. The basis for the decision concerning the need for a change in a plan is a resolution of the commune board made after the analysis of the proposed motions and evaluation of the management condition and also the ascertainment of the expiry of the current plan. The change causes expiry of previously issued decisions on the spatial management and development, which are inconsistent with the findings of the changed plan, if they were a basis for not issuing a building license.
