Tomträtt är en form av nyttjanderätt till fastighet. Tomrätt innebär en upplåtelse av mark i princip i evig tid mot en årlig avgift (avgäld). Tomträtter kan bland annat överlåtas och hyras ut. Det är främst kommun eller stat som har rätt att upplåta tomträtter. Kommunerna har möjlighet att frisälja tomträtter.

A site leasehold is a type of right of use of real property unit. Site leasehold means that land has been made available, in principle for ever, against an annual fee (rent). Site leaseholds can be transferred and rented. It is primarily municipalities and the state that are entitled to make site leaseholds available. Municipalities can sell off site leaseholds.
